Terms of Service

1. Account

You must be at least 13 years old (16 in the EEA) to create an account. You're responsible for keeping your password secure and for all activity under your account.

2. Subscriptions & Credits

• Subscriptions auto-renew unless you cancel. You can cancel anytime in your billing settings.
• Credits are a virtual currency used to access paid AI features. Credits have no cash value, are non-refundable, and expire if your account is inactive for 12 months.
• Prices may change with 30 days' notice for existing subscribers.
• Refunds: we offer pro-rated refunds for annual plans within 30 days. Credit packs are non-refundable except as required by law.

3. Your Content

You own the content you create on Cinelity (scripts, characters, generated images, generated videos). By using the service you grant us a limited licence to host and display your content so we can run the platform.

You can delete your content at any time. We may retain deletion logs and backups for up to 90 days.

4. AI-Generated Content

Cinelity uses third-party AI models (OpenAI, Anthropic, Google, Runway, Luma, Pika, Stability, ElevenLabs, and others). Each provider has its own usage policies that you must also comply with.

You are responsible for ensuring your prompts and uses of generated content comply with applicable law and don't infringe third-party rights. Cinelity provides no warranty that AI output is original, accurate, or free of third-party claims.

5. Acceptable Use

You agree NOT to:

• Use the service to generate content that is illegal, defamatory, harassing, infringing, or sexually explicit (including CSAM — strict zero-tolerance).
• Reverse-engineer, scrape, or attempt to circumvent rate limits or paywalls.
• Resell or sublicence the service.
• Generate content impersonating real people without consent.
• Upload viruses, malware, or content that exploits security flaws.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

6. Intellectual Property

The Cinelity name, logo, and platform code are our intellectual property. You may not use them without permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

9. Termination

You can delete your account at any time in settings. We may terminate or suspend your account if you breach these Terms.

10. Changes to Terms

We may update these Terms. Material changes will be notified by email and on this page. Continued use after a change constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of [INSERT US STATE] (operator: fill in your state), without regard to conflict of law principles. Disputes will be resolved in the courts of that state.
